Since 18 February 2026, the norm according to which a challenge could not be filed against the judges of the Constitutional Court has been excluded from the Constitutional Court Law. Now the law does not prevent this, but the Rules of Procedure of the Constitutional Court do not yet regulate the procedure for deciding on a challenge to a judge at the stage of examining an application.
In accordance with Section 26(1) of the Constitutional Court Law, issues not regulated by this Law and the Rules of Procedure of the Constitutional Court shall be decided by the Constitutional Court. In a preparatory meeting, the Constitutional Court determined that the decision on a challenge filed against a judge of the Constitutional Court at the stage of examination of an application lies within the competence of the panel sitting or preparatory meeting to which the examination of the relevant application has been assigned.
The judge against whom the challenge has been filed is heard at the panel sitting or preparatory meeting, and the decision on the challenge is adopted by the remaining members of the panel sitting or preparatory meeting by a majority vote. If the votes are equally divided, the judge is disqualified.
